Consumer Terms & Conditions of Vehicle Sale
These Terms apply when you buy a vehicle from us as a consumer.

1. About Us

We are Sparks Commercial Services Ltd (“we”, “us”, “our”), a UK vehicle supplier. These Terms set out your rights and our responsibilities when you purchase a vehicle from us.

2. Your Consumer Rights

If you are buying as a consumer, you benefit from important legal rights, including:

-       The vehicle must be of satisfactory quality, fit for purpose and as described.

-       If the vehicle is faulty, you have rights to repair, replacement, or refund.

-       These rights exist in addition to anything we agree with you in writing.

-       Nothing in these Terms affects your statutory consumer rights.

3. Vehicle Information

We aim to describe and photograph vehicles accurately. Please note:

-       Small variations in mileage or condition may occur due to movement or storage.

-       You are welcome to inspect the vehicle before completing your purchase.

-       If anything important changes, we will tell you before you enter into the contract.

4. Prices & Payment

-       Prices exclude VAT unless stated otherwise.

-       Full payment must be received before the vehicle is released to you.

-       We will confirm your order and payment arrangements in writing.

5. When Ownership Passes to You

-       Ownership of the vehicle passes to you once you have paid in full.

-       However, risk does not pass until the vehicle is delivered to you or collected by you.

-       This means that we are responsible for the vehicle’s condition until handover.

6. Delivery or Collection

We will agree a collection or delivery date with you.

6.1 Delivery

If we deliver the vehicle:

-       Risk passes to you when the vehicle arrives and you receive it.

-       We will give you reasonable delivery estimates and update you if things change.

6.2 Collection

If you choose to collect the vehicle:

-       Risk passes to you when you take possession of it at our premises.

-       You should bring ID and any documents we ask for.

7. If You Change Your Mind (Cooling‑Off Period)

If you purchased the vehicle without visiting our premises (online, over the phone, or by email):

-       You may cancel the purchase within 14 days of receiving the vehicle.

-       You must return the vehicle to us in the condition received, allowing for reasonable inspection.

-       We will refund you within 14 days of receiving the returned vehicle.

-       Exceptions apply where the vehicle has been customised to your specific request.

8. If the Vehicle Has a Fault

If the vehicle develops a fault, you have the following rights:

-       Within 30 days: You may reject the vehicle for a full refund.

-       Within 6 months: We must repair or replace the vehicle unless this is impossible or disproportionate.

-       After 6 months, you still have rights if the fault was present when supplied.

-       Manufacturer warranties may provide additional protection, which we will explain during the sales process.

9. Storage (When You Ask Us to Hold the Vehicle)

If you ask us to hold the vehicle for a period after you have paid:

-       We will store it safely until your agreed collection or delivery date.

-       Risk does not pass to you until you physically receive the vehicle, even if paid in full.

-       If storage extends beyond the agreed period, reasonable storage charges may apply we will tell you before they apply.

10. Cancellation (Face‑to‑Face Sales)

If you purchased the vehicle in person at our premises, there is no automatic cooling‑off period, but:

-       You may cancel before collection or delivery if agreed with us in writing.

-       Deposits may be refundable or non‑refundable depending on what we agreed at the time of sale we will always make this clear.

11. Our Liability to You

We are responsible for:

-       damage caused by our negligence;

-       supplying a vehicle that meets consumer law standards;

-       losses caused by our failure to meet our obligations.

We are not responsible for:

-       losses related to your business use of the vehicle;

-       indirect losses that could not have been reasonably foreseen.

-       Nothing in these Terms limits liability for death, personal injury, fraud, or anything else the law does not allow us to exclude.

12. Complaints

If you are unhappy with any part of your purchase:

-       We will investigate promptly and aim to resolve issues amicably.

13. Governing Law

-       These Terms are governed by the laws of England and Wales.

-       You may bring legal proceedings in your local UK court if you live outside England.
