Business Repair & Service Terms & Conditions
(Including Sparks Commercials Swindon Ltd, Sparks Commercials Poole Ltd, Sparks Commercials Portsmouth Ltd, and Sparks Commercials Exeter Ltd)
These Terms apply when we accept a vehicle for repair, servicing, inspection, estimation, storage, or any associated work.
1. Estimates
1.1 Estimates are valid for 28 days from the date issued. 1.2 If we do not receive your instructions within 26 days, we may charge standard garage rates from the date we received the vehicle until collection. 1.3 If we carry out the quoted work and you pay in full, we typically do not charge for storage while awaiting your instruction.
2. Pricing
2.1 Prices are based on the cost of labour, parts, and materials at the time of quotation. 2.2 If these costs change before or after acceptance, we may adjust the final price accordingly. 2.3 Where no price was quoted, or only part of the quoted work is completed, we will charge a reasonable and proper price for:
- the work carried out;
- any investigation, dismantling, or reassembly; and
- parts and materials supplied.
2.4 If work proves impracticable, we may limit the work to what is reasonably possible.
3. Variations
Any variation to the estimate or scope of work will be subject to these Terms and does not create a new contract.
4. Completion Times
We will do our best to meet estimated completion times, but cannot accept liability for any delay, even when a specific date is given.
5. Authorised Instructions
You are responsible for any work authorised by:
- your employees or drivers;
- anyone reasonably appearing to act on your behalf; or
- anyone authorised to collect the vehicle.
6. Payment
6.1 Payment is due on completion of the work. 6.2 We may request a deposit before or during the work. 6.3 A repair is deemed complete when we notify you that the vehicle is ready for collection.
7. Lien & Retention of Title
7.1 We have a general lien over your vehicle and its contents for all monies owed to us. 7.2 Parts supplied remain our property until paid for in full. 7.3 We may charge storage while the lien is exercised.
8. Disposal for Non‑Payment
If your account remains unpaid for 12 months from the first invoice, we may sell the vehicle and/or contents by auction or private sale. Proceeds will be used to settle your debt, and any surplus held in trust.
9. Vehicle Collection
If someone who appears authorised collects the vehicle, we are not responsible for confirming their authority, even if payment has not yet been made.
10. Storage Charges
If the vehicle is not collected within 24 hours of completion, we may charge storage at £12 per day until collection or disposal.
11. Road Testing & Movement
Unless you notify us in writing, you authorise us to test‑drive or move the vehicle as required for the work.
12. Liability
12.1 We are not responsible for loss or damage to vehicles or property unless caused by our negligence or deliberate act. 12.2 We accept no liability for indirect or consequential loss.
13. Parts & Workmanship Warranty
13.1 We use quality parts but accept no responsibility for manufacturer or subcontractor defects. 13.2 You are entitled to any manufacturer warranty available. 13.3 Our workmanship is warranted for 3 months or 3,000 miles, whichever is sooner. 13.4 Warranty applies only to the specific repair, not progressive fault diagnosis.
14. Removed Parts
Parts removed during repairs will become our property if not collected within 14 days.
15. Notices
Notices sent to your last known address will be treated as properly delivered.
16. Definition of “Vehicle”
“Vehicle” includes any car, van, lorry, trailer, caravan, cycle and all individual components (engine, gearbox, axle, etc.).
17. Variations to These Terms
These Terms may only be varied in writing by a Director or authorised officer of the Company.
18. Service Standards
Unless otherwise stated, service work follows the manufacturer’s service schedule.
19. Credit Accounts
19.1 Payment terms are 30 days from invoice date. 19.2 We may terminate credit immediately on breach, and all sums become due immediately. 19.3 Interest may be charged daily on overdue balances.

Customers are advised to have appropriate insurance. Our pricing assumes we are not liable for loss or damage except where caused by our negligence.
